Lucrezia Borgia Posted December 7, 2020 Share Posted December 7, 2020 thanks Nori - many of the journos I work with have been caught out by this section - they have numerous sources who want to go on the record and tell their story - as a way of healing, for themselves personally - but hopefully too to bring the issue of sexual assault to light so it can be aired in a full and frank discussion with a view to understanding how we can stop it. no good comes out of stopping discussion and hiding issues away where no one can see them, air them, or talk about them. Guest Posted December 7, 2020 Share Posted December 7, 2020 So people have to go to court why? Why can only a magistrate determine whether there's any kind of minor rights involved? Surely it could be a purely administrative form type application process where it's assessed by the relevant child protection authority just to double check before granting permission to the survivor. Fixing it was part of the Justice Legislation Amendment (Supporting Victims and Other Matters) Act 2020. Adult victim survivors now don’t have to go to court to tell their own story. Yes - the provisions relating to deceased victims mentioned above were removed during the parliamentary debate, for consultation with families which I think will happen early 2021.
